They colors you set in the type dialog box will not be set in the application. Photoshop is designed that way intentionally to allow you to change color of type without altering your pallette color. It's nothing your doing wrong and it's not a bug in the application. If you notice when you select the type tool and type new text the color from you last type will still be set in the type dialog box.
As far as not being able to add new layers.... Go to Image > Mode and make sure your image is in RGB Mode. Then you should be able to add a new layer. Most gif files are in Index mode.
